With Chief Justice John Robert’s confirmation that the leaked “Dobb’s Opinion” is authentic, the battle lines have already hardened around the prospect of Roe v. Wade (1973) being overturned. On the left are the predictable warnings of back-alley abortions with coat-hangers and the demise of women’s rights. On the right is justifiable rejoicing…assuming, that is, the “Draft” mirrors what will be the Court’s final Opinion.

The leaked “1st Draft” dates back to early February, which means there are others likely circulating among the Jurists. On the other hand, if the goal of the “leaker” was to put public pressure on the Court to change minds, then the Draft probably still forms the kernel of the majority’s thinking, which means the end of Roe. Time will tell. The final Opinion is due sometime in June.

Dobbs will not, however, spell the end of abortion in the United States, only its Constitutional grounding. As was true before 1973, the issue will now be decided by the states. According to various sources, some two dozen states will act quickly to ban abortion outright. Thirteen states have so called “trigger laws” which automatically bans abortion if Roe is overturned.

California will not be one of them!

In anticipation of Roe’s overthrow, Governor Gavin Newsom promised to make CA the most abortion friendly state in the nation – an abortion “sanctuary.”

It gets worse.

The Governor helped organize over 40 pro-abortion groups who fancy themselves the “California Future of Abortion Council.” Members include Planned Parenthood, the ACLU, NARAL, and ACCESS REPRODUCTIVE JUSTICE to name a few. Working with the state’s lawmakers, in February they began advancing AB-2223, a law that would effectively legalize perinatal infanticide. “Perinatal” refers to the period, usually a matter of weeks, before and after birth.

What, specifically, does AB-2223 propose? Under the banner of “reproductive justice,” “intersectional and multifactored issues,” and “systemic racial inequities,” the bill states that:

(a) Notwithstanding any other law, a person shall not be subject to civil or criminal liability or penalty, or otherwise deprived of their rights under this article, based on their actions or omissions with respect to their pregnancy or actual, potential, or alleged pregnancy outcome, including miscarriage, stillbirth, or abortion, or perinatal death due to a pregnancy-related cause.

(b) A person who aids or assists a pregnant person in exercising their rights under this article shall not be subject to civil or criminal liability or penalty, or otherwise be deprived of their rights, based solely on their actions to aid or assist a pregnant person in exercising their rights under this article with the pregnant person’s voluntary consent.

While the bill is careful to replace the word “woman” with “pregnant person,” it deliberately omits defining what constitutes a “perinatal death due to a pregnancy-related cause,” which means it is open to subjective interpretation. But expressly including the term, “perinatal death,” meaning in the weeks after birth, as being protected against criminal prosecution is highly incriminating and reveals the bill’s true intent.

What this means is that a parent, “acting” alone or with professional help, can kill their born child and claim it was “pregnancy-related” to avoid legal consequence. To dissuade law enforcement from investigating such matters, under the bill police officers who attempt to intervene or prosecute what could otherwise be a capital crime can be civilly sued.

That such a law has been introduced is itself breathtaking. That it is moving successfully through the legislative committee process is a moral scandal.
